Article 1 – Definitions
“General Terms and Conditions” These general terms and conditions apply to every legal relationship between a Visitor and the Organiser concerning attendance at an Event with a Ticket, the purchase of a Ticket, and any related product or service (including those offered by Third Parties) via the Website.
“Visitor” Any individual attending an Event or purchasing a product or service via the Website, acting as a consumer under Dutch law (Section 6:231(c) of the Dutch Civil Code). The Visitor is not acting in a professional or business capacity.
“Third Party(s)” Any external party offering products or services related to the Event, not being the Organiser or part of Pal Mundo International B.V.
“Event”: Any public event—single- or multi-day, indoor or outdoor—organised by the Organiser in the Netherlands, including but not limited to festivals, concerts, club nights, and associated facilities (e.g. camping, hospitality). These Terms apply to all such events under the Pal Mundo brand.
“Organiser” Pal Mundo International B.V., the legal entity responsible for the Event and the contracting party to the Visitor. The Organiser operates the Website and manages all aspects of the Event.
“Ticket” An admission ticket—physical or digital (with barcode)—that grants the Visitor access to the Event.
“Website” Any official website operated by Pal Mundo International B.V. where Visitors can find Event information and purchase Tickets or related products/services.
Article 2 – Applicability and Contact
2.1 These General Terms and Conditions apply when a Visitor purchases a Ticket, attends the Event, whether the Event is a festival, concert, club night, or other production organised under the Pal Mundo brand, or buys related products/services via the Website. By completing any of these actions, the Visitor agrees to these Terms. This also applies to Tickets obtained via third parties.
2.2 The Organiser is Pal Mundo International B.V., located at Retiefstraat 75B, 1092VZ Amsterdam, the Netherlands, registered under Dutch Chamber of Commerce number 98085875. Contact details: info@palmundofestival.com, www.palmundofestival.com
Each edition of the Event may operate under its own subdomain or contact address, which will be clearly listed on the Website.
Article 2.3 – Related Companies
If an Event is organised by a company affiliated with Pal Mundo International B.V., and the General Terms and Conditions are published on the relevant Event Website, then that affiliated company shall be considered the Organiser and contracting party under Section 6:231(b) of the Dutch Civil Code. Pal Mundo International B.V. itself will not be the contracting party or legal user of these Terms and Conditions in such cases, nor will it be liable to Visitors under these Terms.
Article 2.4 – Reference to Terms
The Organiser refers to these General Terms and Conditions on the Ticket. Visitors may also access the Terms at the entrance of the Event, where they will be made available in full or in excerpt.
Article 2.5 – Access During Purchase
During the purchase of a Ticket or related product/service (including those of Third Parties) via the Website, the Visitor will have the opportunity to review these General Terms and Conditions before concluding the agreement electronically.
Article 2.6 – Scope of Application
These General Terms and Conditions apply exclusively to private individuals acting as consumers. Parties acting in a professional or commercial capacity are subject to separate contractual terms agreed with the Organiser.
Article 3 – Amendments to the Terms
3.1 The Organiser reserves the right to amend or supplement these General Terms and Conditions at any time. Any updated version will be published on the Website and will take effect from the date of publication. If changes materially affect the rights or obligations of the Visitor, the Organiser will notify the Visitor via email or clearly communicate the changes during the Event or on the Website.
3.2 By continuing to visit the Event or purchase Tickets or related products/services after such amendments, the Visitor irrevocably accepts the updated Terms. If the Visitor does not agree, they must immediately cease use of the Website and refrain from attending the Event or making further purchases.
Article 4 – Ticket
4.1 Entry to the Event is only granted upon presentation of a valid and undamaged Ticket. Visitors may be required to show proof of identity for age verification. Once a Visitor exits the Event grounds, the Ticket becomes invalid.
4.2 Visitors under the age of 18 will be denied entry unless explicitly stated otherwise by the Organiser (e.g. in cases where a different legal drinking age applies). No refund will be issued in such cases.
4.3 Tickets remain the property of the Organiser. Only the first person to present and scan the Ticket at the entrance will be admitted. The Organiser assumes this person is the rightful holder and is not obligated to verify further. Visitors are responsible for ensuring they are the sole holder of the Ticket issued by the Organiser or its authorised sales partners.
4.4 Once the Ticket is issued, the Visitor bears all risk of loss, theft, damage, or misuse. Each Ticket is issued once and grants access to one person only.
4.5 The Organiser may impose a maximum number of Tickets per Visitor. Visitors must comply with such limits.
4.6 Only Tickets purchased through authorised (pre)sale channels or directly from the Organiser are guaranteed to be valid. The burden of proof lies with the Visitor. Tickets may be delivered electronically (e.g. via email barcode). Visitors must ensure secure receipt and accessibility of the Ticket. The Organiser cannot guarantee confidentiality or successful delivery. Scanning from a mobile device is at the Visitor’s own risk. If scanning fails, no refund or compensation will be provided.
Article 5 – Prohibition Against Resale and Transfer
5.1 Tickets for the Event may not be resold by the Visitor for commercial purposes under any circumstances.
5.2 The Organiser may designate an authorised resale platform (e.g. TicketSwap) as an official secondary sales channel. Reselling Tickets via any other platform or channel is strictly prohibited. Tickets purchased through unauthorised sources may be invalidated, and access to the Event may be refused. The Organiser accepts no liability for losses or damages resulting from such transactions.
5.3 Visitors are not permitted to advertise, promote, or publicly associate themselves with the Event without prior written consent from the Organiser.
5.4 If a Visitor transfers a Ticket to a third party, they must ensure that the transferee accepts and complies with all obligations under these General Terms and Conditions. The original Ticket holder remains liable for any breach by the transferee.
5.5 Breach of any provision in this article may result in an immediately payable penalty of €10,000 per violation and €5,000 per day for each continued violation, without prejudice to the Organiser’s right to seek further damages or legal enforcement.
5.6 In case of non-compliance, the Organiser reserves the right to cancel the Ticket and deny the Visitor access to the Event. No refund or compensation will be provided.
Article 6 – Searches and Camera Surveillance
6.1 The Organiser reserves the right to search Visitors or arrange for searches prior to or during the Event. Refusal to cooperate may result in denial of entry or removal from the Event without refund.
6.2 Surveillance cameras may be in operation at the Event venue for safety and security purposes.
Article 7 – Prohibited Items
7.1 Visitors may not bring or possess any of the following items at the Event venue: professional recording equipment, drones, glassware, plastic bottles, alcoholic beverages, extended selfie sticks (>1.5m), food, drugs (including substances listed under the Dutch Opium Act), nitrous oxide cartridges, cans, fireworks, animals, weapons, or dangerous objects (e.g. spray cans, CS gas). Venue-specific policies may apply. Confiscated items will not be returned.
7.2 Violation of this article may result in denial of entry, removal from the Event, or referral to law enforcement. The Organiser reserves the right to destroy confiscated items.
Article 8 – Refusal of Entry
The Organiser may refuse entry or remove any Visitor if deemed necessary for public order, safety, or violation of these Terms. This includes offensive clothing, discriminatory signs, non-compliance with dress code, or undressing during the Event. Holders of counterfeit or invalid Tickets will be denied entry without compensation.
Article 9 – Film and Video Recordings
9.1 Professional or commercial recording of the Event (including photography, filming, drones, or reproduction of printed materials) is prohibited without prior written consent from the Organiser.
9.2 Personal recordings using non-professional devices (e.g. smartphones) are permitted for private use only and may not be published or used commercially.
Article 10 – Own Risk and Liability
10.1 Visitors attend the Event and use associated facilities (e.g. parking, camping, shuttle buses) at their own risk. The Organiser is not liable for personal damage or loss.
10.2 Loud music will be played. Visitors are advised to wear ear protection and take breaks. The Organiser is not liable for hearing loss, visual damage, or other injuries.
10.3 The Organiser is only liable for direct damages caused by its own proven fault, and only up to the amount covered by its liability insurance.
10.4 Liability for indirect damages (e.g. lost profits, business interruption) is excluded.
10.5 Damage claims must be reported within 48 hours after the Event via the contact details in Article 2.2.
10.6 The Organiser is not liable for damages caused by third parties or subcontractors involved in the Event.
10.7 Visitors shall indemnify the Organiser against third-party claims resulting from their own actions or omissions.
Article 11 – Programme
The Organiser will strive to follow the published Event schedule but is not liable for deviations, delays, or changes in performance length or content. Start times are subject to change.
Line-Up and Changes The Organiser presents a carefully curated line-up of multiple artists. While the organizer strives to ensure all announced acts perform as scheduled, changes may occur due to circumstances beyond the organizer’s control. The cancellation or absence of one or more artists does not entitle ticket holders to a refund, unless the festival is cancelled in its entirety.
Headline Acts and Substantial Impact If one or more headline acts—defined as artists clearly promoted as major audience draws—are cancelled and this results in a substantial alteration of the festival’s core concept, the organizer reserves the right to offer appropriate compensation. This may include partial refunds, a revised program, or a voucher for a future event.
Article 12 – Further Rules
12.1 Visitors must comply with all instructions from the Organiser, venue operators, transport providers, security, emergency services, and other authorised personnel. Surveillance may be in place.
12.2 Non-compliance may result in removal from the Event. Additional venue-specific rules may apply and will be communicated on-site or via the Website.
Article 13 – Cancellation or Relocation Due to Force Majeure
13.1 In case of force majeure—including but not limited to artist illness, strikes, terrorism, government orders, fire, or extreme weather—the Organiser may cancel or relocate the Event, including festivals, concerts, or club nights, to a different date or venue.
13.2 The Organiser is not liable for damages resulting from cancellation or relocation. Notification will be made via the Website and/or other appropriate channels.
13.3 In case of full cancellation, the Organiser will refund the Ticket price (excluding service fees and travel/accommodation costs) only if the Ticket was purchased via authorised sales channels.
13.4 Refunds will be processed within a reasonable time after the cancelled Event, upon presentation of a valid, undamaged Ticket.
13.5 If the Event is cancelled due to force majeure, only partial refunds may apply. No replacement access to other events will be granted.
13.6 If the Event is rescheduled, Tickets remain valid for the new date. Visitors unable to attend may request a refund (excluding service fees) by submitting a valid Ticket to the authorised sales channel within the specified timeframe.
13.7 In addition to the above, the Organiser reserves the right to relocate the Event, including festivals, concerts, or club nights, to a different venue within the Netherlands for operational, safety, regulatory, or logistical reasons, even if no force majeure applies. A change of venue under such circumstances does not entitle the Visitor to a refund, provided the Event proceeds as scheduled or is rescheduled within a reasonable timeframe and geographic proximity. The Organiser will notify Visitors of any venue change as soon as reasonably possible via the Website and/or registered contact details. The Organiser is not liable for any costs incurred by the Visitor as a result of such relocation, including travel or accommodation.
Article 14 – Image and Sound Recordings
14.1 The Organiser and performing artists are authorised to make or commission image and/or sound recordings of the Event and its Visitors for commercial purposes. By purchasing a Ticket and entering the Event venue, the Visitor unconditionally consents to such recordings and their use, publication, and processing in any form, without entitlement to compensation. By attending any Event—including festivals, concerts, or club nights—the Visitor consents to image and sound recordings
14.2 The Visitor irrevocably waives any personal interest in such recordings. If the Visitor holds any copyright, neighbouring rights, or portrait rights, these are unconditionally assigned to the Organiser. The Visitor also waives personality rights and agrees not to invoke them. If required, the Visitor shall confirm this in writing or sign a deed of transfer at the Organiser’s request.
Article 15 – Smokefree Event
15.1 Smoking and e-smoking are prohibited in all indoor areas of the Event, including temporary structures, tents, and covered spaces. Smoking is only permitted in designated outdoor areas.
15.2 The Organiser will take reasonable steps to communicate the smokefree nature of the Event but cannot guarantee full compliance. No refunds or compensation will be provided if the Event is not entirely smokefree.
15.3 Breaches of smoking bans may result in removal from the Event. Any fines imposed on the Organiser due to a Visitor’s breach will be recovered from that Visitor.
Article 16 – Tokens
Tokens purchased during the Event are valid only for that specific edition. The Organiser is not obliged to refund unused tokens after the Event. If the venue uses a different payment method (e.g. cashless systems), the venue’s own terms and conditions apply.
Article 17 – Electronic Payment Instruments
The Organiser may use open-loop or closed-loop electronic payment systems during the Event, including debit/credit card transactions or prepaid Event-specific payment cards.
Refunds of remaining credit on such cards will not be processed during the Event. Visitors may request a refund within two weeks after the Event via the procedure outlined on the Website. After this period, the right to a refund expires.
Refunds may incur processing fees, which will be communicated on the Website. The payment card must be retained by the Visitor to verify remaining credit. Lost or stolen cards cannot be refunded. The Organiser is not liable for such loss or theft.
Article 18 – Lockers
Lockers may be available for rent at the Event. Visitors receive a personal code to access their locker. Third-party terms may apply and are accepted upon rental.
The Organiser is not liable for loss, theft, or misuse of locker codes. Visitors are advised to keep codes confidential and avoid storing valuables in lockers.
Article 19 – Camping Facilities
Camping facilities may be offered at the Event, subject to availability and with a valid camping ticket. In addition to prohibited items listed in Article 7, the following are not permitted at the campsite:
• Vehicles (campers, caravans, vans, etc.)

• Sharp objects, tap systems, sound systems (except small radios)
• Barbecues, cooking equipment, generators
All vehicles must be parked in designated areas.
Article 20 – Campsite Rules
20.1 Camping is only allowed in tents or accommodations provided by the Organiser. Sleeping in vehicles is prohibited. Visitors must carry their own belongings to the campsite.
20.2 Visitors may bring limited quantities of non-alcoholic or low-alcohol beverages as specified on the Website. Glassware and strong alcohol are prohibited. No drinks or food may be taken from the campsite to the Event venue.
20.3 Visitors and their luggage will be searched at both the campsite and Event entrance.
20.4 Trading is prohibited in all areas. Defacing goods is only allowed in designated zones. Waste must be disposed of in provided bins.
20.5 Climbing on stages, barriers, or structures is strictly prohibited. Violations may result in removal without refund.
20.6 Specific campsite rules may apply and will be communicated on-site or via the Website. These rules take precedence over general terms in case of conflict.
20.7 The Organiser may issue additional campsite rules regarding:
• Use of showers and sanitation
• Waste disposal
• Tent placement
• Permitted food and drink
• Compliance with instructions from staff and authorities
• Prevention of nuisance and safety risks
Article 21 – Purchase of Tickets
21.1 Tickets for the Event are typically sold via authorised third-party platforms such as Paylogic. These platforms may apply their own terms and conditions for payment and delivery, which are binding on the Visitor. The Organiser is not responsible for the content or enforcement of these third-party terms.
21.2 The Organiser is not liable for errors, technical issues, or payment failures occurring on or through third-party ticketing platforms or their integration with the Website.
21.3 Tickets cannot be returned. The statutory right of withdrawal does not apply, pursuant to Article 6:230p(e) of the Dutch Civil Code. By purchasing a Ticket, the Visitor enters into a leisure services agreement for a specific date and time. This exclusion is clearly communicated prior to purchase via the Website.
These provisions apply to Tickets for all Events organised by the Organiser, including festivals, concerts, club nights, and other productions.
Article 22 – Agreements with Third Parties
22.1 The Website may offer products or services from Third Parties, either directly or via hyperlinks. If the Visitor chooses to purchase such offerings, they enter into a separate agreement with the Third Party, which may be subject to that party’s own terms and conditions. The Third Party is solely responsible for fulfilling its obligations.
22.2 While the Organiser selects Third Parties with care, it is not a party to these agreements and bears no liability for their performance. The Visitor indemnifies the Organiser against any claims, costs, or damages arising from such agreements.
Article 23 – Travel, Transport, and Airline Tickets
23.1 Travel packages or transport services offered via the Website are handled by Third Parties. The Visitor enters into a transport agreement directly with the provider. The Organiser is not a party to these agreements.
23.2 The Visitor indemnifies the Organiser against any claims or damages resulting from such agreements. Applicable terms and conditions of the Third Party can be found on their respective websites.
Article 24 – Offers by Standholders at the Event
Visitors may encounter Third Parties offering products or services at the Event (e.g. food, drinks, merchandise, fairground attractions). Although selected with care, the Organiser is not a party to any transaction between the Visitor and these vendors.
The Organiser is not liable for any damage or dissatisfaction resulting from such purchases. The Visitor indemnifies the Organiser against any claims arising from these transactions. Applicable terms may be requested directly from the Third Party.
Article 25 – Further User Rules
25.1 Visitors must comply with all published regulations, amendments, and instructions issued by the Organiser, whether on the Website, at the Event venue, or at the campsite.
25.2 Failure to comply may result in suspension of services, termination of the agreement without compensation, or enforcement of specific performance, depending on the circumstances.
Article 26 – Website Information
While the Organiser strives to provide accurate information, it cannot guarantee the completeness or correctness of content on the Website. The Organiser is not liable for any consequences arising from use of this information.
Hyperlinks to Third Party websites are provided for convenience. The Organiser is not responsible for the functionality, content, or accessibility of these external sites.

Article 28 – Liability
28.1 The Organiser is not liable for errors or omissions on the Website unless caused by intent or gross negligence. Neither the Organiser nor its partners are liable for indirect damages, including loss of profits, data, or privacy.
28.2 The Organiser does not guarantee uninterrupted or flawless operation of the Website. Due to internet vulnerabilities, it cannot ensure protection against viruses, bugs, or cyberattacks. Visitors are responsible for securing their own devices.
28.3 The Organiser is not liable for damages resulting from interactions with Third Party websites or social media content.
28.4 The Organiser is not liable for theft or loss of personal belongings at the Event venue or campsite.
Article 29 – Complaint Period
Complaints must be submitted within three months after the Event via the contact details provided in Article 2.2. The Organiser is not obliged to respond to complaints received after this period.
Article 30 – Personal Information
The Organiser processes personal data of Visitors and Website users in accordance with its Privacy & Cookie Statement, the General Data Protection Regulation (GDPR), and the Dutch Implementing Act GDPR. The applicable privacy statement is available at www.palmundofestival.com/privacy.
Article 31 – Intellectual Property Rights
31.1 All content made available via the Website, social media, or during any Event—including concerts and club nights—including music files, artist names, label names, streams, downloads, software, designs, logos, and trademarks—is protected by intellectual property rights held by the Organiser or its licensors.
31.2 Visitors must respect these rights and comply with all legal restrictions. These Terms do not transfer or license any intellectual property rights to the Visitor.
31.3 The Dutch Copyright Act and related laws apply fully and take precedence over these Terms. Specifically:
a) Visitors may only make private use of purchased content. Circumventing payment systems or reproducing, distributing, or exploiting content is strictly prohibited.
b) Private copies for personal, non-commercial use are permitted. Sharing with third parties is not allowed.
c) Software security measures are part of the protected content.
d) Purchasing a file does not grant any promotional or commercial rights.
31.4 If a Visitor breaches intellectual property laws, the Organiser may notify the rights holder, who may pursue legal action.
Article 32 – Replacement Clause
If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions remain in full force. The invalid provision will be replaced by one that closely reflects its original intent and is legally permissible.
Article 33 – Applicable Law and Jurisdiction
Dutch law governs these General Terms and Conditions. Any disputes arising from these Terms, related agreements, or their execution shall be submitted to the competent court in Amsterdam, unless otherwise required by law.
Article 34 – Alternative Dispute Resolution for Online Purchases
If a dispute arises between the Visitor and the Organiser regarding an online purchase and cannot be resolved amicably, the Visitor may file a complaint via the European Commission’s Online Dispute Resolution platform: http://ec.europa.eu/consumers/odr
